In the "Allocation of Costs" section of the Real Estate Purchase Agreement, most WOOD DESTROYING INSPECTION REPORTS should be limited to the interior of the condominium only. Most condominium associations are responsible to maintain the common areas. As the Home Owners Association maintains certain portions of the structure, those portions of the structure may be excluded from the inspection at the request of owner or agent. The inspection should be limited to the "separate interest and exclusive use areas being transferred" as spelled out in the Real Estate contract (see our page on the Residential Purchase Agreement). However, we are required by the Structural Pest Control Board to inspect the entire unit up to the common wall (for full disclosure) unless otherwise directed. It is our advice that if the owner is responsible for the "interior only", that the owner or agent should request the inspection be limited to the interior only. We are required to disclose in the report the person requesting the limited inspection. The owner or agent should be careful to have all areas inspected which they are responsible to maintain. Some common areas, hot tubs, decks, patio covers or enclosure fences may be areas which are considered "separate interest and exclusive use areas being transferred". Prior to ordering an Inspection Report the owner or agent must be familiar with the C.C.R.s of the Association and order inspection of ALL the appropriate areas being transferred. Key Termite and Pest Control does not verify these responsibilities or assume liability for areas not inspected. If you are unable to determine the extent of responsibility, full inspection should be completed.
